When Business Kills: The Emerging Crime of Corporate Manslaughter
This book aims to explain in clear, accessible language, the approach taken by government to corporate offending resulting in a fatality in both the United Kingdom and the United States. The key provisions of the statutory offense of corporate manslaughter, introduced into the United King-dom in 2008, are examined, and set in context through a consideration of their relationship with prosecution for fatalities at work via the Health and Safety at Work etc Act 1974. Further contextualization is made through comparison with the current position in the United States, highlighting both similarities and differences in approach to occupational fatalities. The range of potential penalties is discussed with particular focus on the sentencing guidelines that apply after February 2016. Concluded corporate homicide cases are reviewed in order to assess the current regime in terms of financial penalties and to shine light on the evolving approach of the prosecuting authorities and the courts to these offenses.

About the Author
Field, Sarah: - Sarah Field, MA (OXON), LLM, holds a master's in jurisprudence from the Queen's College, Oxford, and an LLM in international criminal law. She leads the postgraduate law program at the University of Brighton where she specializes in criminal law and the law of contract. She has published widely on her particular area of interest, the criminal liability of corporations, and recently published a textbook on contract law. Her work has frequently been cited by other academics in the field.
Jones, Lucy: - Lucy Jones, LLB, LLM, Solicitor (nonpractising), is a principal lecturer in law and head of the law subject team at the University of Brighton. She has extensive experience in teaching and supervising students. Lucy is the author of Introduction to Business Law, first published by Oxford University Press in 2011 and now in its 4th edition. She has presented conference papers and published widely in national and international journals on the topic area of criminal liability of corporations.
